Am i missing something here?, bare with me

Ok so im not sure where to put this but i guess it would be under relationships since we are having a problem with our neighbour

ok heres the background story. Our neighbour Phil Duran built a house next to us. Living in northern Michigan we have lots of sand underneath the grass. So when it rained all the sand water and mud ended up flowing to our yard. This started about August 2007. WE politly asked him if he could clean it up. He said he would, we even have written proof that he said he would. 3 weeks later, nothing finally after a month he "fixed" it by laying hay all over it which did absolutly nothing. It rained again and our yard was flooded again but he wouldnt fix it becuase he said it was already fixed. About June 2008 my family has had about enough with this and decided to take legal matters. First time we sent out the forms saying what we were going to do he just sent them right back. The second time the papers said if he doesnt answer in 7 business days we would take him to court. He did answer and he was also suppose to actually clean up our yard and fix it.

So today (july-7-08) He came to our yard without notifying us, technically trespassing. Thoug however a few conversations between him and my mom later we found out he wasnt fixing our yard like he has been notified to do. He has been fixing our neighbours yard
(also on the whole neighbour thing we have a problem with phil duran who lives kiddie corner from us, not our neighbbour to the straight left of us)

also the point of that hill thing is to divide our property with the neighbours

You can see two stakes and he says that, that half is apparently our neighbours (to the left) property. Last time i checked and the papers of him showing us that was our property. He also says that our side of the mud is fixed.
Okay, so if its so fixed then why is he fixing their side of it? Was his worse? Last time i checked and all of the pictures we have it looked exactly like the same.
Also he was notified to fix the whole disaster not just one side and if any side our side.
I know that sounds selfish, but this has been going on for almost a year and were completely fed up with him and his bull shit

What am i missing here? How is our side "better" its deffinatly not better and its just screwing him over more and more

This is the best part. The excess dirt they have, they were raking piles of it under the tree to the right (which is on our property) and a little under the small tree to the left.

So overall he is
1. Not doing what he was said to do FROM the court
2. He is now telling us that, that side isnt our property which we swear was.
3. He is taking all the excess dirt and raking it under the tree's of our property.

We also have more pictures and recorded him on tape.

but i would like to hear some of your opinions

I cant say much... my yard looks like that all the time. but i live in a forest... so haha... its ok to me.

The only problem is that its been there for almost a year. Its also been sitting water for about a few months which means if someone got into the water they could get sick. There are a few little kids in my neighbourhood so its technically a potential danger.
