Never been an issue for me. At least, nothing worth complaining about. Maybe that person likes blinding you with their background and their ugly font.
 I mean, it's their profile. It should be their choice.

Oh yeah, I noticed that today. First myspace removed the "is", and now facebook did. I really don't care, but I usually use "is" anyway. Also, like Eddie said, you can pretty much make your status say what you want with the "is" still there.
