lol anyways Im doing a report on Supreme Court cases I just need some proof reading see if it sounds legit.
Supreme Court Case Study The Rights of People of Suspect Ethnic Backgrounds Korematsu v. United States, 1944 Issue : American born Japanese fighting for rights for being accuse of being a spy for the Japanese during WWII.. Background : Japanese were told to relocate in and out of the U.S by Executive order of President Franklin Delano Roosevelt. Not to long after the bombing of Pearl harbor for the defense of national security. And by the Order of President Roosevelt Japanese Americans and also Native Born Americans of Japanese background were forced out of their homes. To be interned in Camps and kept hostage. Almost 112,000 Japanese were sent to camps/relocated. Supreme Court Decision : It was a vote to 6-3 against korematsu. Government brought up a similar case of another Japanese American by the name of Hirobayashi. The court decided that the Military should have granted powers to take the necessary action to protect their people. Supreme Court took their actions based on a statement from Justice Black that approximately Five thousand Japanese did not swear allegiance to the U.S. Dissenting Opinions : Justices Frank Murphy and Robert H. Jackson had different outlooks on the situation. Murphy thought the Court decision was an act of racism and being unconstitutional. He also objected that their rights were not being violated, but their freedom was in Jeopardy. He also stated that The U.S should have don’t what Great Britain does to people in accusation during the war. Was to do hearing. Justice Jackson argued about the Military procedures were unconstitutional. He stated that even if those orders were permissible, they lack the constitutional understanding of what Our nation stands for. Questions : 1. The Constitution based their decision through the executive demand. During war actions needed to be done in order to protect their country. 2. If I was a native-bore Japanese American I would’ve reacted in a rebellious way because my rights are being taken away without a fair hearing. 3. I would say No, he didn’t state the other side of the Japanese who were confused and hurt by their decision. 4. On Murphy’s dissent he based his argument of the means of the constitution and it’s true meaning. He argued that the constitutional decision was unfair and worst an act of racism. 5. The description fits, Military powers can be abusive and at times unfair. |
