PEOPLE covergirl Lindsay Lohan will no longer be bothered by her father, a New York judge ruled on Thursday.

Michael Lohan, 44, was officially barred from contacting his 18-year-old daughter and ordered to serve 28 days in an upstate New York rehab clinic, followed by five years' probation, New York's Daily News reports.

"If you don't stay in the program, I will put you back in jail," Nassau County Court Judge Claire Weinberg warned the elder Lohan. Prosecutors say Lohan could face up to four years behind bars should he violate any of the 13 orders of protection taken out against him by family members.

Said his lawyer, Dominic Barbara: We are hoping and praying that this (rehab) facility is going to work for him and his life's going to get a lot calmer."

Earlier this month, Lohan was arraigned for allegedly violating an order of protection obtained by his estranged wife (and Lindsay's mom), Dina, for driving under the influence of drugs. Last May he was arrested for allegedly assaulting his brother-in-law at a First Communion party in the family home.

"Michael has problems that he needs to deal with – he needs to take care of himself," Dina tells PEOPLE in the new issue, adding that she plans to file for divorce from her husband of 19 years next week.

Not surprisingly, Michael has a different take. "I just want to be a father, I want to take care of my family," Michael told PEOPLE on Dec. 5 from the Nassau County Correctional Center, where he was being held on $1 million bond.

He added: "I want nothing to do with Lindsay's business or life. I just want to be Daddy. That's all."
