If they layout is registered as a trademarked/copyrighted material at http://www.copyright.gov/register/visual.html then you can file a lawsuit if you want, but if its not registered at a copyright office, then it cannot be processed as a lawsuit.


And since the original image in the design isn't your, but you modified it, then you should also have a copyright notice to the gaming company or the author of the game/anime etc

dont go putting Copyright 2004 whatever on ur site, since u know it's not registerd! u damn whiny kids. shifty.gif

You can sue the person for damages though. Even if it isn't registered at a copyright office, It's still possible to sue.

However, on the copyright, you must put your real name, or legal alias. For example, I can't put Copyright 2004 kryogenix, because kryogenix is not a legal alias. I would have to put my real name. Same thing goes with adding studios or incorporated. If it's not a registered business, you don't own the copyright.
