As the nominee, and therefore head of the Republican Party, he can do whatever he wants to do, concerning his campaign (you know, short of blatantly breaking the law, cheating, etc). The debates aren't even required by law, they're just customary. But it's not going to look good for McCain if the Commission on Presidential Debates says to go forward, and Obama is the only one that shows up.
