A 17-year-old spent a night in jail last week after police arrested him for wearing low pants in Riviera Beach, southeast Florida.

The law banning so-called "saggy pants" was approved by city voters in March after supporters of the bill collected nearly 5,000 signatures to put the measure on the ballot.

The teen would have received a 150 dollars fine or community service, but he spent the night in jail due to a history of marijuana use, the Palm Beach Post newspaper said.

"Somebody help me," said Palm Beach Circuit Judge Paul Moyle, before giving his decision.

"We're not talking about exposure of buttocks. No! We're talking about someone who has on pants whose underwear are apparently visible to a police officer who then makes an arrest and the basis is he's then held overnight, no bond."

"Your honor, we now have the fashion police," added public defender Carol Bickerstaff, who asked the law be declared "unconstitutional."

The judge agreed with Bickerstaff immediately, reported the Post.

Laws that ban low-slung pants are on the books in several US cities, including Delcambre, Louisiana, where offenders can be fined up to 500 dollars or jailed for up to six months.

Dallas, Texas and Atlanta, Georgia are among the larger US cities considering similar measures.

LMAO!!! Ok i know this is a trend,which has been around awhile.In my opinion it looks terrible BUT what gets me is all these young fella's & "rappers" wearing their pants down so low thinking they look kool when in fact they don't know the true meaning of it.!! It in fact is a prison thing meaning that if you wear your pants low you are " available " if you get what i mean loool.gif rofl1.gif tease.gif laugh.gif wink.gif I laugh hysterically to myself each time i see the fools thinking they are hot!! And in New Zealand once told a young guy what it meant whilst i was walking home from work ..you should have seen his face.I never did see him with such low pants on again lmao.

@ him or anyone who actually believes that. This is incorrect and nothing but a myth to keep kids from sagging their pants. Sagging did originate in prison but has nothing to do with homosexuality whatsoever. To keep prisoners from committing suicide they weren't given belts thus their pants sagged and that is the truth.

In high school, my Criminal Justice class took a field trip inside a prison. We were actually walking among the prisoners, talking to them, and seeing how they live day to day. I learned that they even offer jobs inside the prison. They only make about 40 cents an hour though. It was a cool experience. Our group had body guards so it was a little nerve wracking at first, but no one ever bothered us. At one point we were taken into a room and got to ask questions. The warden and several prisoners were there to answer. A classmate asked that very question, about the baggy pants, and a prisoner told us that whole "system" is an unfortunate truth, and sagging pants is, in fact, a sign of availability. That was the first time I had ever heard of baggy pants being a sign of availability. The warden also commented that they issue clothes that fit for every prisoner so that there's no way anyone can stand out as individuals by the clothes they wear. For example, sagging pants. He also said prisoners get punished if they're caught showing any signs like that.

But, that's just what they said. Who really knows. I've never been to prison myself, other than that field trip, so I would have to take their word for it. It could differ from prison to prison.
