I disagree. Anything you create is protected under US and UK copyright law - just because something is in the so-called "public domain" (re - the internet) doesn't make it a free for all.
What works best for me is a polite request first reminding them that I, as the creator, expect recognition for my efforts. Free graphics take the designer just as much time as those that charge for them, so kindly remind them of that fact. Then you can always read through some legal stuff like the DMCA (link here) and know exactly where you stand. Generally, host sites and ALL good web-designers respect the copyright licensing that protects online work. They should do, people have been sued for infringement in the past. Although it's highly unlikely to even go that far unless you have the time, patience, money and resources; copyright infringment is still a serious civil offense. I contacted the blog site Xanga regarding their policy and their standard reply was to direct me toward a form (a Notice of Copyright Infringement) that I must fax to them along with proof that the copyrighted work really is my own. This then gives them permission to order a 'Take Down' of the offending hosted site; basically giving Xanga legal credence to remove the site entirely should a warning not be met with compliance. Most sites have this sort of policy. But, it's a long process. I'd start with simple requesting before getting technical on their ass. |
