As I said, the code you have hides the ad. When the ad is hidden it will get your profile deleted.
This is the code for the banner: CODE <div style="position: absolute; top: 30px; left: 310px; width: 150px; height: 16px; background-color: transparent;background-image: url();"><img src="http://img64.imageshack.us/img64/8461/bathtubbannervt6.png"></div> If that goes over the myspace ad you can get your profile deleted.
