question: the definition of creating a layout |

Hi
I just wondered if someone could define 'creating' a Xanga layout? Does the designer also have to create the background image that goes with the layout, or are they able to use images from other sites without any credit as their background and still continue to ask for credit for the layout? Just an update - the user has contacted me to apologise and the site now has credits for the background :)
