question: the definition of creating a layout

Hi
I just wondered if someone could define 'creating' a Xanga layout? Does the designer also have to create the background image that goes with the layout, or are they able to use images from other sites without any credit as their background and still continue to ask for credit for the layout?

I am asking this because I have discovered a free graphic image on my site has been used by a 'layout maker' on Xanga as part of their background. No credits were given to my site at all (I didn't ask specifically for a linkback I guess) but they claim the layout to be their own - part of their disclaimer is

The actual image link used in the layout is directly linked from my site so I seriously doubt it can be just 'coincidence'.

So I wanted to check first that there wasn't another set of rules on Xanga governing that the 'creation of a layout' applied purely to code.

I find it ironic that the same user has rules such as

QUOTE
DO NOT "JOCK" ANY LAYOUTS
YOU MUST LEAVE THE LINK BACK TO ME ON YOUR SITE.
DONT LEAVE STUPiD // iGNORANT COMMENTS. iLL DELETE THEM.
DONT LEAVE RUDE COMMENTS. iF YOU DONT LiKE MY S***. LEAVE!


I have attempted to leave comments twice (saying that it would be nice to have some credit) but both have been deleted by the user. Apart from renaming the image file (which I don't think is ideal - due to the possibility of other users using the same file on their site - and they probably wouldn't appreciate a broken link) I'm reall not sure what to do with this user.

Nevertheless, thank you both again for your help!
