help with comment box/manual submit Options

i have a comment box in my old layout but when i try to put it in my new one, the submit button doesn't show up so i use the manual submit . instead of submitting the page is submits the comment box so it says 'must be friend to comment'
help would be much appreciated

instead of using
java script:document.forms[1].submit();

you have to use
java script:document.forms[2].submit();
