What, nothing about Prop 8?

California's Proposition 8, which introduced an amendment to the CA constitution that forbid gays and lesbians from marrying, was overturned by the CA State Supreme Court on the grounds that it is unconstitutional. (The case is being appealed to the 9th Circuit.)

Thoughts?

i'm glad, i think it's the right decision.


i know this kind of stuff goes state by state and no one else is directly effected, but i wonder what it means for everyone else and what may end up coming from this on a larger scale

i'm glad that died out. i'm shocked though that people would actually pass that when it was available and actually thought it was constitutional.

If the case does reach the U.S. Supreme Court, things should prove really interesting if Elena Kagan tips the Court's liberal balance.

nothing because i don't think majority dictates something as right. but then again i'm black so you know i can sympathize. millions of white people might think i shoulda been lynched or not marry a white girl and i don't think it would make it any more right.

Issue is with majority rules, sometimes the majority is f*cking stupid. When you compare the 2 arguments, there just seems to be a clear winner imo.

where are you from? do you not read or watch the news?

I'm so excited that they've overturned prop 8. Unfortunately, it may not stay that way, especially with the current Supreme Court being the most conservative it's ever been in recent years. I'm not sure even if Elena Kagan votes prop 8 unconstitutional, if it'll be enough to tip the balance.

iirc the judge is staying his decision because everyone and their mother knows it's going to be appealed, so nothing really happened yet.

Repeal all marriage laws. Government should be totally out of marriage, whether they are gay or straight. So if men wanna the woman of their dreams/nightmares, men want to marry 5 women, gays wanna marry gays, men wanna marry their cars, women wanna marry their shoes, pedobear wants to marry a 9 year old, etc. they can all be free to get their own marriage certificates from whatever private organization they wish. No discrimination.

And I can be free to disregard their marriages and laugh at them.

LOLWHITEGIRL. No but I'm pro interracial relationships, both are people why the f*ck not, right? White people who are like "zomg wtf he's dating a white girl one of our own!" are f*cking pathetic and that thinking is reason enough to not date them. Same thing goes with asian dudes getting crazy pissed about other races dating asian girls. It's not like they're being forced, their choice.

I don't think that the majority agreeing on something necessarily dictates it as right, either. I'm not sure that the supreme court will overturn this. I haven't seen the conservativeness in the recent years, but I'm not trying to start an argument over that here lol. I think America in general has become more socially liberal, and I think the majority of the people who oppose things like this are people who are generally older holding on to older American values and particularly citing things like religion as reasons behind the way they think. I understand the importance of religion and all, but that just seems kinda dated regarding how you think throughout your life. I argue with my parents allllllllll the time about gay marriage. They're Christians, not necessarily like omg i love jesus don't speed don't do anything wrong ever you'll go to hell christians, but enough so that they oppose gay marriage. It's stupid.

I don't think Government should be involved in what individuals can or cannot do. Social liberalism is a good thing, so long as what they do doesn't hurt others. What the f*ck is Gay marriage going to do to hurt someone? Omg they cross swords disgusting!!!11!

Well, obviously because the people of California didn't know what they were doing was unconstitutional. They just heard, "Oh shit, gays gonna married!" and went out to put a stop to it (with help from the Catholic church and the LDS, of course). Legislatures often pass laws that aren't constitutional; it's not up to the legislature to determine constitutionality, that's why we have a judicial branch.

Generalizing yes, in the sense that any vote/election is a generalization of the opinions of individuals. But if you think I'm generalizing re: religion, look at the breakdown of the voting by demographic.
