Doesn't matter. What does, however matter, is the fact that the NY Governor said he's to receive no special treatment. That's basically the gov saying that he's guilty no questions asked.

he's stupid. we talked about this in class today. i don't even care if he goes to jail or not, he should. even if he did have a permit, it's still stupid to me. if you feel like you need to take a gun to a club to be safe, then don't f*cking go to the club.
