Getting paid over Daylight Saving Time

Something I've been wondering as of late. Consider this:

You work in a pizza shop that is open until 3 AM. You are working the morning that DST ends. You started work at 8 PM. You work until 2 AM, then, of course, the clocks shift back an hour. You then work two more hours until 3 AM and then you go home.

How long do you get paid for--seven hours, or eight? Does it make a difference if you use a time clock to punch in?

good question. i think youd just work til 2 am (without going back an hour).

But if it's open to 3 AM, by definition, you'd have to be there until 3.

I agree You should get paid for tha AMOUNT of hours you work not the p[unch in time

I think you should get paid for the amount of hours you work.

But that's a good question. How did you come up with it?

Last Saturday night I was walking back from a friend's house around 1 AM and I saw a pizza guy delivering a pizza. I wondered, if he worked past two, how he would get paid.

Whether he punched in a time clock or not, he would get paid for eight hours. I'm almost positive that it counts the number of hours you work, not from one time to another.

I think it's a loophole that employer's rarely great and look forward to a lot.... just like employee's beg to work random national holidays for extra money... what's fair is getting paid for the hours you work, the reality is that nothing's fair :(

Hmm...never happened to me before, but I would say yes. He should get the amount per hour he worked, not what the time was.
