I have no idea where to put this.
I joined this community to voice a complaint.

My name is Audrey, I owned eyepaint.net and My DA account is driverside. I was looking through your backgrounds and found this-

To be quite honest, I'm so freaking tired of being copied. The two are way, way too similar. She also used some of my brushes that I had as a resource on eyepaint- so obviously she got the "idea" from me.

Be original.

first off, these backgrounds are not the same.
it's ok if somebody produces their own graphic using inspiration from yours-there is no breech of copyright there.
there is absolutely nothing wrong with somebody using that inspiration. it's their work, even if they "stole" the idea from you. be honored that somebody liked it enough to produce their own graphic. once again, you should be happy that somebody used you as inspiration, and didn't copy your exact graphic.

you said the brushes were a resource. unless i'm mistaken by your definition of resource, you didn't make the brushes. if, however, you did make these brushes, then you have a right to want credit.

I never said that they were the same. I said "copied" not "stolen".

I guess my definition of resource is different. I did make quite a few of those brushes.

To be honest, get over it. There will always be people who'll copy your designs whether you like it or not. That is simply how people are. I'm sure that some of your layouts were inspired by other people. If you don't want your stuff copied, then don't display it in the public. And besides, if you don't want your stuff used (in ex: your brushes) and that you have a problem with her using it, then don't display it on your site. :).

Would you prefer it if they credited you for the brushes? If you made the brushes and weren't given credit for it, that that is against our rules - using resources without asking for permission.

I'll admit that the two images are very similar, but the only thing we're really able to go off of is the brushes, so let us know what you want us to do - we'll do our best to help in any way possible.

Okay, I understand. :) Yeah I would like credit for the brushes.

pinch.gif I don't even see how their similar, I've seen so many collage style layouts, that you can't even say that your not copying someone else out there.

Aye, I feel for you - but ideas are one of the exceptions to the law of copyright. However, if you specify in your site's Terms that your brushes are linkware, you are more than deserved of credit.

The designer happily added links to credit you for using the brushes, and even for the concept on the background image (and her coded version of the layout).
